Transmission owners and Regional Transmission Organizations need federal limitations on their potential tort liability.

Liability limitation is a critical provision of any federal transmission tariff.  Transmission owners have traditionally had this protection under state tariffs, but with the development of RTOs and other transmission organizations such as ITCs, these state protections may not apply.

EEI has advocated that there should be no liability for ordinary negligence. In the case of gross negligence or willful misconduct, recovery should be limited to direct damages.
