  • WOTUS:  The Clean Water Act’s Answer to the Question, “How Complicated Can One Definition Really Be?” 

    The Clean Water Act gives the federal government authority to regulate “waters of the United States” (WOTUS), while all other waters fall under the protection of state and local governments.  But decades of litigation and numerous agency rules and guidance documents have failed to definitively answer the fundamental question: which waters are actually WOTUS?  For February’s Grid Talk, Amanda Aspatore, EEI’s Associate General Counsel for Litigation and Environment, and Riaz Mohammed, EEI’s Manager, Environmental Programs, will discuss the history of the WOTUS definition, recent litigation and administrative actions, and what’s at stake for electric companies.
